Project Background/Rationale

An AusAID governance strategy mission conducted in February-March 2000 determined that the biggest single issue constraining development and economic growth in Indonesia is the dysfunctional legal system. Attention to this problem will assist the enabling environment for a resumption of economic growth, equitable income distribution and a fairer and more just society.

Description of Goals/Objectives

The goal of the Indonesia Legal Reform Program Facility is to promote governance in Indonesia by supporting the reform of the existing legal system to develop functional, transparent, accountable and competent legal institutions and by supporting measures to ensure the implementation of the rule of law. This will be achieved by providing targeted assistance for Indonesia's legal reform efforts to a number of key institutions and organisations likely to have central roles. This includes Government and non-government organisations.

The project commenced in May 2001 and will run for two years.

Project Examples to date include:

  • Assistance to the Ministry of Justice and Human Rights to draft Anti-Terrorism Legislation
  • Provision of a long-term Human Rights Adviser for the Ministry of Justice and Human Rights;
  • Assistance to the Supreme Court to conduct a class action procedural rules comparative study and international workshop in Jakarta;
  • Assistance to the National Ombudsman Commission with investigations training;
  • Support to Pusat Studi Hukum dan Kebijakan (PSHK) to publish a Citizen’s Rights Publication and to organise a series of workshops on Indonesia’s Bankruptcy Law;
  • Support to Yayasan Lembaga Hukum Indonesia to conduct advocacy training for trial lawyers;
  • Support to the University of Indonesia and ICEL to organise training on Alternative Dispute Resolution; and
  • Support to the Steering Committee of the Commercial Court to Train Commercial Court Judges in Intellectual Property Rights.
